These General Terms and Conditions (GTC) apply to all contracts, deliveries and other services between Aurora Engineering GmbH (hereinafter "Aurora") and its customers, unless otherwise agreed in writing.
(1) The presentation of services on the Aurora website does not constitute a legally binding offer but an invitation to submit an offer.
(2) By ordering a service the customer submits a binding offer to conclude a contract. Aurora may accept this offer by written confirmation or by providing the service.
(1) Aurora's services are based on the current service descriptions on the website or individually agreed offers.
(2) All prices are in euros and exclude statutory VAT unless otherwise stated.
(1) Payments are due without deduction after invoicing. Different payment terms require a written agreement.
(2) If the customer falls into default of payment, Aurora is entitled to charge default interest at 5% above the respective base rate.
(1) Aurora performs the agreed services to the best of its knowledge and ability.
(2) The customer undertakes to provide Aurora with all necessary information and documents required for performance of the service in good time.
(1) Aurora is liable for damages only in cases of intent or gross negligence. For slight negligence Aurora is liable only for breaches of essential contractual duties (cardinal duties), limited to the foreseeable, contract-typical damage.
(2) Liability for lost profit or other financial damage of the customer is excluded.
Aurora undertakes to treat all information of the customer obtained during cooperation as confidential and not to disclose it to third parties.
(1) The law of the Federal Republic of Germany applies.
(2) Should individual provisions of these GTC be or become invalid, the effectiveness of the remaining provisions shall remain unaffected.
